1. INFORMATION FOR USERS

Data controller

Carbonell Fortuñy Notarios Asociados, S.C.P is the DATA CONTROLLER of the USER’s personal data and informs the USER that this data will be processed in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and Spanish Organic Law 3/2018 of 5 December (LOPDGDD).

Purpose of processing

The personal data provided through the contact form on this website will be processed for the following purposes:

  • General enquiries. To respond to requests for information made by the USER through the web form.
  • Initial contact relating to notarial instructions. To deal with requests connected to notarial services, on the understanding that the website does not handle complete notarial matters but only the initial contact prior to formal instruction.

This website has no subscription or newsletter function and does not send marketing communications.

Data processed

The contact form collects identification and contact data only (name, email address, telephone number and the content of the message).

No special category data is collected (special categories of personal data under Article 9 GDPR). The website does not allow documents or attachments to be submitted.

Legal basis for processing

The legal basis varies according to the purpose:

  • Article 6(1)(b) GDPR, where the processing arises from requests relating to notarial services, since it is necessary in order to take steps prior to entering into a contract or to establish a professional relationship.
  • Article 6(1)(f) GDPR, for general enquiries not linked to a specific notarial instruction, the DATA CONTROLLER having a legitimate interest in dealing with requests for information received through its website.

Retention period

The retention period depends on the nature of the communication:

  • General enquiries. Data will be kept for as long as necessary to deal with the enquiry and, once it has been resolved, for a maximum of one year, unless there is another basis justifying its retention.
  • Requests relating to notarial instructions. Data will be kept in accordance with the legal obligations applicable to notarial practice, including the retention periods laid down in notarial and tax legislation.

Once these periods have elapsed, the data will be deleted using appropriate security measures to guarantee its complete destruction or anonymisation.

Disclosure of data to third parties

Data is not disclosed to third parties for commercial purposes.

Data collected through the contact form is processed solely by the DATA CONTROLLER and, where applicable, by technical suppliers strictly necessary for the operation of the website (email and hosting services), acting as data processors under Article 28 GDPR. No external sales management tools or CRM platforms are used.

Any disclosure of data arising from the exercise of the notarial function is made in accordance with the specific legislation applicable and falls outside the scope of this website.

User rights

The USER has the following rights:

  • The right of access, rectification, portability and erasure of their data, and the right to restrict or object to its processing.
  • The right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) if they consider that the processing does not comply with current legislation.

The DATA CONTROLLER guarantees that personal data is processed lawfully, fairly and transparently, and that it is adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed, in accordance with the principles set out in Article 5 GDPR.
